TO ENSURE THAT THE AFFAIRS OF THE BOARD AND ITS COMMITTEES MAY BE CONDUCTED IN AN ORDERLY MANNER TO ENSURE THAT ALL PERSONS DESIRING TO ADDRESS THE BOARD ON MATTERS PERTINENT TO IT ARE AFFORDED AN OPPORTUNITY TO DO SO.

TO PERMIT PERSONS IN ATTENDANCE TO OBSERVE AND HEAR THE PROCEEDINGS OF THE BOARD WITHOUT DISTRACTION AND TO PERMIT TO THE FULLEST, FULLEST EXTENT THE BOARD TO CONDUCT COUNTY BUSINESS WITH MINIMAL DISRUPTION.

THE FOLLOWING RULES ARE ESTABLISHED.

A, EACH PERSON DESIRING TO SPEAK MUST SIGN UP IN ADVANCE OF THE OPENING OF THE CITIZEN'S COMMENT PERIOD ON THE AGENDA.

B, EACH SPEAKER SHALL BE LIMITED TO A PERIOD OF THREE MINUTES PER COMMENT PERIOD.

WHEN TWO MINUTES HAVE PASSED, THE SPEAKER WILL BE REMINDED THAT THERE IS ONE MINUTE REMAINING.

I SEE SOME OF, UH, UH, STATED THAT THEY WILL BE TALKING ABOUT, UH, SYCAMORE CROSS AND JUST WANT TO GET THAT THE TWO MIXED UP.

WE HAVE PUBLIC HEARING ON SYCAMORE CROSS FOLLOWING OUR PUBLIC COMMENTS.

AND HAVING SAID THAT, OUR FIRST, UH, PERSON FOR PUBLIC COMMENTS WILL BE, UH, DR. LAWRENCE BILL PUBLIC CAUGHT BY SURPRISE.

I THOUGHT IT WAS AT THE END GUILTY FOR HAVING TO READ THIS, BUT I'M TOO OLD TO THINK ON MY FEET ANYMORE.

TWO, I THANK YOU FOR DOING YOUR JOB WITHOUT HESITATION, MAKING BOLD AND COURAGEOUS DECISIONS IN THE FACE OF DISRESPECT AND PETTY OPPOSITION.

AND THREE, I THANK YOU FOR THE MANY ACHIEVEMENT FOR THE COUNTY OVER THE LAST 45 YEARS TO HELP S COUNTY BECOME

THE SPECIAL PLACE THAT IT IS.

MY THANK YOU.

MY THIRD THANK YOU DEMANDS A BRIEF HISTORICAL PERSPECTIVE.

WHEN I CAME TO COUNTY IN 1968, HOWEVER, LEFT IN 1975 AND RETURNED IN 2000, MOST OF ITS RESIDENTS WERE BLACK, BUT IT HAD NO BLACK ELECTED OFFICIALS, NO BLACK ADMINISTRATORS, NO, NO GOVERNMENT CENTER, NO PARKS AND RECREATION CENTER, NO MEDICAL CENTER TO MENTION A FEW, BUT NOW WE HAVE THEM.

AND MORE SPECIFICALLY, IN 1968, THE COUNTY WAS OPERATED BY WHITE ELECTED OFFICIALS WITH ALL BLACK PARTICIPATION EXCEPT FOR ONE DEPUTY SHERIFF.

SINCE THE EARLY 1970, HOWEVER, THE COUNTY HAS HAD THREE BLACK AND TWO WHITE BOARD MEMBERS.

BESIDES THAT, OTHER BLACKS HAVE BEEN ELECTED TO DIFFERENT POSITIONS AND BOARDS.

WHEN I RETURNED TO THE COUNTY UNTIL 2000, I THOUGHT THE RACIAL ISSUE HAD BEEN SETTLED.

WHEN I ATTENDED THE BOARD MEETING TWO, TWO YEARS AGO TO BE RECOGNIZED FOR MY 90TH BIRTHDAY AND TO, AND, AND AGAIN LAST YEAR WITH MY WIFE TO BE RECOGNIZED FOR HER 90TH BIRTHDAY, I DISCOVERED THE SAD TRUTH THAT THE CIVIL WAR, IN A VERY REAL SENSE, STILL BEEN FOUGHT THAT I DID, WAS BROUGHT TO LIGHT IN DECEMBER.

WHEN I READ AN ARTICLE BY THE EDITORIAL BOARDS OF THE SMITHFIELD TIMES, IT BEGINS WITH, HAVE ONE MINUTE DR.

WE LONG FOR TODAY.

IT BEGINS WITH WE LONG FOR THE DAY WHEN RACE IS NO LONGER A PREVAILING FACTOR IN POLITICS IN A SENTENCE, WE ALL LONG FOR THAT.

BUT IN CONTEXT, THAT STATEMENT REFERRED TO THREE BLACK BOARD MEMBERS WHO VOTE FOR PROGRESS.

AND THE TWO WHITE MEMBERS WHO APPEAR, AND I UNDERSCORE THE TERM, APPEAR, APPEAR TO VOTE FOR RETURN TO THE PAST.

INDEED, UH, THE VOTES WERE RACIAL BUT NOT RACISTS.

THE VOTES REPRESENT OPPOSITE WORLDVIEWS, PROGRESSIVE AND CONSERVATIVE.

ANOTHER THANK YOU GOES IS TO THE COUNTY ADMINISTRATOR FOR THAT'S OUR TIME, SIR.

MY NAME IS SHALON PIERCE.

I'M A MEMBER OF THE BACON'S CASTLE COMMUNITY.

UM, I WOULD LIKE TO SAY FIRST THAT THE, WE HAVE NOT TALKED ABOUT I COMMENTS, BUT THEY'RE SIMILAR IN NATURE.

I TITLED THIS IS IT, NO VOICE, RACISM, OPPRESSION, OR SIMPLY THE ACTIONS OF THE MAJORITY IN AUTHORITY.

RECENT ACTIVITY IN THE SMITHFIELD TIMES PROTESTS PRIOR TO BOARD MEETINGS AND APPARENT THREATS TOWARDS OUR BOARD MEMBERS WOULD HAVE ONE PUNT OF THE QUESTION, ARE THERE RACE RELATION ISSUES IN SURY COUNTY? SOME WILL SAY NO.

MAYBE SOME WILL SAY YES.

I'M NOT SURE IF THE RECENT CONCERNS FROM BOARD MEMBERS ABOUT VOICE AND BEING HEARD ARE RACIALLY RELATED OR NOT.

WHAT I AM CERTAIN OF IS THAT THERE IS A MAJORITY AND A MINORITY IN TERMS OF RACE ON THE BOARD.

AND THOSE WHO ARE IN THE MINORITY ON THE BOARD ARE OFTEN IN THE MAJORITY IN OTHER SETTINGS IN THIS STATE AND NATION.

IT IS ALSO TRUE THAT THE MAJORITY OF DECISIONS ARE MADE BY THOSE ON THE BOARD WHO ARE PEOPLE OF COLOR.

WHAT I WANT TO SAY TO THE BOARD MEMBERS WHO SAY THEIR VOICE IS NOT HEARD, I BEG TO DIFFER.

YOUR VOICE IS HEARD DURING BOARD DISCUSSIONS DURING THE MEETING ON ACTION ITEMS AND NON-ACTION ITEMS DURING BOARD COMMENTS.

AND WHEN YOU SPEAK WITH YOUR CONSTITUENTS, CONSTITUENTS BY VARIOUS MEANS, INCLUDING THE SMITHFIELD TIMES.

HOWEVER, HAVING HEARD ONE'S VOICE AND HAVING ONE'S DESIRED OUTCOME APPEAR TO BE DIFFERENT IN MOST CASES.

WELCOME TO THE WORLD OF THOSE OF US WHO HAVE BEEN OPPRESSED, MARGINALIZED, AND TREATED UNFAIRLY SINCE OUR ANCESTORS WERE BROUGHT OVER HERE FROM THE CONTINENT OF AFRICA MANY YEARS AGO.

I UNDERSTAND WHAT YOU'RE FEELING.

MANY OF US WHO ARE PEOPLE OF COLOR HAVE FELT THIS WAY ALL OF OUR LIVES.

THE DIFFERENCE IS THE ACTIONS OF THESE MAJORITY BOARD MEMBERS ARE NOT OPPRESSIVE, DO NOT MARGINALIZE, AND ARE THE RESULT OF CONVERSATIONS WITH THEIR CONSTITUENTS.

WHEN I SAY THAT I'M TALKING ABOUT ONE RACE OR ANOTHER, THEY IMPACT ALL OF US.

YES, SIR.

I HEAR YOU.

YES.

THEY HEAR MANY VOICES.

THEY HAVE TOUGH DECISIONS.

THE DIFFERENCE

LET'S PLAY THE PROGRESSIVE AND WHO HAS THE POWER AS GIVEN TO THEM BY THE VOTERS OF THIS COUNTY CARD.

LET'S UNDERSTAND AND ACCEPT THAT OUR VOICE IS BEING HEARD, BUT THE POWER IS IN THE VOTE OF THE MAJORITY, BOTH AT THE POLLS AND DURING BOARD MEETINGS.

THERE'S A POLITICAL THEORY WRITTEN A HUNDRED YEARS AGO THAT STATES, FOR A POLITICAL OR COMMUNITY GROUP POWER TO BE ESTABLISHED AND ENDURE.

THERE MUST BE A DISTINCTION BETWEEN FRIEND AND ENEMY.

WE SEE THIS PLAYED OUT IN OUR NATIONAL POLITICS TODAY, AND WE SEE IT BEING PLAYED OUT IN SURREY.

WHEN THE FRIEND ENEMY DISTINCTION IS ESTABLISHED, IT BECOMES IMMORAL TO TREAT YOUR ENEMIES WITH KINDNESS, A BETRAYAL OF YOUR SIDE IF YOU DO SUCH.

LET'S FACE IT, AND WE HEARD IT HERE TONIGHT.

OUR COUNTY IS CULTURALLY DIVIDED.

IT JUST IS.

AND I UNDERSTAND.

WHEN I WAS ON THE BOARD, I BECAME CONCERNED HOW A FORMER COUNTY ADMINISTRATOR WAS TREATING SOME EMPLOYEES AND TREATING A FAMILY IN THE DISTRICT.

I ACTED.

I HAD AN EEOC COMPLAINT FILED AGAINST ME AND DISMISSED.

WHEN I WAS ON THE BOARD, I MADE A MOTION TO REMOVE THE CONFEDERATE MONUMENT FROM THE COURTHOUSE YARD.

I FELT IT WAS THE RIGHT THING FOR ME TO DO.

I FELT IT WAS THE RIGHT THING TO DO FOR THE COUNTY AND THE COMMUNITY THAT I HAD SPOKEN WITH.

WHEN I WAS ON THE BOARD, I MADE THE MOTION TO APPOINT MS. ROLLINS AS THE COUNTY ADMINISTRATOR BECAUSE AT THAT TIME, IT WAS THE RIGHT THING TO DO FOR OUR COMMUNITY.

WHAT IS THE RESULT? AND I SYMPATHIZE WITH Y'ALL BEING ON BOARD.

WHEN YOU DO THINGS LIKE THIS, YOU GET KICKED AND YOU GET KICKED BY PEOPLE THAT YOU'RE TRYING TO HELP AND TRYING TO SUPPORT.

YOU GET KICKED.

IT'S SIMPLY THIS VERY WAY IT SEEMS. ONE MINUTE, SIR.

I DON'T WANT MY WIFE, OUR FRIENDS, FAMILIES AND Y'ALL'S EITHER TO BE TREATED THIS WAY.

SEVERAL COMMENTS GO AGAINST YOUR CODE OF ETHICS, SPECIFICALLY ONE WHERE A BOARD MEMBER IS SHARING ANOTHER BOARD MEMBER'S TEXT MESSAGE.

WASN'T THIS ONE OF THE MAIN REASONS YOU RECENTLY UPDATED YOUR CODE OF ETHICS IN THIS POST? THERE WAS A REFERENCE TO A TEXT SENT OUT BY STAFF TO BOARD MEMBERS, AND THE BOARD MEMBER COMMENTED THEY HAD READ THE SAME TEXT MESSAGE THAT THE REPRESENTATIVE FENDEN RECEIVED NO LESS THAN 50 TIMES TO TRY AND SEE WHAT THEY ALLEGED IS THERE EACH TIME IT ESCAPES ME.

THE STATEMENT IN THAT TEXT OF CONCERN IS, I KNOW THAT BECAUSE WE HAVE AFRICAN AMERICANS IN LEADERSHIP POSITIONS, WE ARE DISCRIMINATED ON BIG TIME FACT.

BUT WE WILL CONTINUE TO DO OUR JOB WITH OUR ELECTED LEADERS WHO WILL CONTINUE TO HAVE, MAKE BOLD AND COURAGEOUS DECISIONS RATHER THAN THE SAME 10 PEOPLE WHO CAN HAVE AN OPINION BUT JUST DON'T LIKE THE WAY WE LOOK AND WHO ARE MAKING IMPROVEMENTS TO THE COUNTY.

MR. ELLIOT, WHAT DOES THAT STATEMENT MEAN? THESE 10 PEOPLE JUST DON'T LIKE STAFF OR BOARD MEMBERS BECAUSE OF HOW THEY LOOK.

WHO ARE THESE 10 PEOPLE THAT THE TEXT IS REFERRING TO? IN MY OPINION, THIS COMMENT STATING THAT PEOPLE DO NOT LIKE YOUR DECISION MAKING BECAUSE OF HOW YOU LOOK AND WHEN YOU'RE REFERRING TO SOMEONE'S RACE OR GENDER, THERE'S A DISCRIMINATION ISSUE THAT NEEDS TO BE ADDRESSED.

TWO WOMEN HAVE BROUGHT THIS ISSUE TO YOUR ATTENTION ONE MINUTE THAT THEY ARE EITHER DISCRIMINATED AGAINST OR UNCOMFORTABLE IN THEIR POSITION.

MS. RUY SUGGESTED OF BRINGING IN A THIRD PARTY TO DISCUSS THIS MATTER AND POSSIBLY BRING BETTER UNITY AMONGST EVERYONE.

THERE ARE A CODE OF ETHICS OF PERSONAL USE AND SOCIAL MEDIA AND PUBLIC SPEECH VIOLATIONS AND CONCERNS THAT HAVE BEEN BROUGHT TO YOUR ATTENTION THAT NEED TO BE ADDRESSED.

THIS WILL ALLOW THE CITIZENS OF THIS COUNTY TO FEEL THAT THERE IS A POSITIVE AND CONSTRUCTIVE WORKPLACE ENVIRONMENT FOR SURREY COUNTY EMPLOYEES AND FOR CITIZENS AND BUSINESSES DEALING WITH THE COUNTY.

I AND OTHERS JUST DON'T PREFER THEIR VISUAL AND AUDITORY BLOOD IN THIS BEAUTIFUL COUNTY.

THAT DOESN'T MAKE PEOPLE WITH MY VIEWPOINT EVIL OR RACIST OR A CARP BAGGER IS ONE SUPERVISOR POSTED ON SOCIAL MEDIA, UM, POSTING THAT WAS CRUEL AND UNNECESSARY.

SURREY COUNTY HAS A CODE OF ETHICS THAT IS BINDING ON THE SUPERVISORS.

WHEN A SUPERVISOR SAYS A CITIZEN QUOTE, SHE'S NOT EVEN WORTH IT.

THE BOARD HAS A RESPONSIBILITY TO ENFORCE ITS CODE.

DITTO DISCREDITING A FELLOW BOARD MEMBER ON SOCIAL MEDIA.

IT'S DISAPPOINTING WHEN WE HAVE A BOARD MEMBER COMMENTING IN THAT WAY ON SOCIAL MEDIA, WHICH IN A MANNER THAT APPEARS TO BE IN CON CONFLICT WITH OUR CODE OF ETHICS AND OUR CHAIR CHIMES IN JUST TO SAY, MY NAME'S MISSPELLED.

SO THERE'S SOME THINGS THAT ARE GONNA SLIP OUT OF THAT QUARTER JUST BECAUSE WE'VE DONE HERE RECENTLY.

UM, CUSTOMER SERVICE CENTER GENERATED WORK REQUEST, UH, IN THAT TIMEFRAME.

WE, WE RECEIVED 65.

UH, WE HAVE CLOSED AND COMPLETED ALL 65 OF THOSE IN THAT QUARTER.

UM, AND THEN VDOT GENERATED WORK ORDER, UM, WE GENERATED 180 OURSELVES.

AND WHEN I SAY THAT IS, UM, EITHER US GOING OUT LOOKING AT PROBLEMS AND FINDING ISSUES, THOSE TYPE OF THINGS OR PLANNED WORK THAT WE PUT INTO OUR WORK ORDER SYSTEM.

UH, WE DID TREE CLEANUP, UH, FROM THE STORMS ON ROUTE 6 34, 6 26 COBO COUM WHARF ROAD.

UH, WE DID SLOW SLOPE MOWING, CUTTING BACK ON ROUTE 6 0 9 AND RAILROAD AVENUE.

UH, WE DID A, A BEACONS CASTLE DITCHING PROJECT THAT, UH, FEEDS INTO THE COMPLETED SMART SCALE PROJECT THERE.

SO WE'RE, WE'RE DOING A LITTLE BIT OF CLEANUP AS WELL AS PRESENTING NEW ARTICLES TO YOU.

UM, THE, THE SOLAR ORDINANCE, UM, IS BREAKING DOWN INTO A COUPLE DIFFERENT PIECES.

UM, WE'RE PLACING, UH, NEW REQUIREMENTS IN THE APPLICATION, ADDING SOME AREAS TO THE PROJECT NARRATIVE, THE CONCEPT DEVELOPMENT PLAN, COMMUNITY IMPACT ASSESSMENT, TRANSPORTATION AND TRAFFIC CONTROL PLANS, CULTURAL, HISTORIC PLANS, LANDSCAPING AND BUFFERING COMMUNITY MEETING REQUIREMENTS.

UM, AND THEN WE'RE ACTUALLY ADDING PERFORMANCE STANDARDS FOR THE USE BY, BY REQUIRING A PROJECT LIAISON, INDEPENDENT ENGINEERS A CONSTRUCTION BOND.

UM, TYPICALLY WE'VE BEEN USED WITH, UH, EROSION MENT CONTROL BONDS, UH, VISUAL IMPACTS, ESTABLISHING REQUIRED SETBACKS AS WELL AS BUFFERS, BUT ALSO EVEN WITHIN THOSE PERFORMANCE STANDARDS, ALLOWING THE BOARD TO, UM, PROVIDE WAIVERS OR MODIFICATIONS BASED ON THEIR, THEIR ANALYSIS OF THE PROJECT.

UM, IF THEY FELT AS THOUGH THERE WAS A GOOD PROJECT THAT THAT COULD USE LESSER REQUIREMENTS IN THE PERFORMANCE STANDARDS.

FOR EXAMPLE, UH, ONE OF THE REQUIREMENTS IS A BUFFER AND ALSO A SETBACK OF 300 FEET AWAY FROM A, UH, PUBLIC RIGHT OF WAY OR PROPERTY LINES.

UM, THIS ANOTHER SECTION ALLOWS THE BOARD TO PROVIDE A MODIFICATION OR A WAIVER TO THAT REQUIREMENT.

SO AS IF IT'S, IF IT'S A GOOD PROJECT, THAT IT'S SOMETHING THAT THE BOARD COULD CONSIDER, UM, WITH, WITHOUT, UM, TURNING AWAY A GOOD PROJECT.

UM, SO THERE'S SOME OF THE THINGS THAT WE, THAT THE, THE BOARD HAS ABILITY TO DO THAT WITHIN THIS ORDINANCE.

UM, IT ALSO DEFINES A COUPLE NEW USES.

UM, THE COMMUNITY SCALE ENERGY FACILITY, UM, THAT'S, UH, UH, SOME OF THE SMALLER PROJECTS.

AND THEN THE UTILITY SCALE, ENGINE ENGINE, UH, ENERGY, UH, UH, FACILITY THAT IS SOMETHING A LITTLE BIT LARGER THAT, THAT WE'RE TYPICALLY USED TO.

THOSE ARE FIVE MEGAWATTS AND ABOVE.

UM, AND THEN WE LOOK AT, UH, TO ADD A DISTRIBUTED, UH, SOLAR ENERGY FACILITY.

THOSE ARE THE PROJECTS THAT WE TYPICALLY SEE, UH, MOSTLY HERE IN SURREY COUNTY AT RESIDENTIAL PROPERTIES THAT WE MAY HAVE ON OUR ROOFS OR OUT IN, OUT IN OUR, UM, OUT IN OUR YARDS.

UH, WE'VE DEFINED THAT, UM, AND DEFINED THAT AS AN ACCESSORY USE.

NOT HAVING TO ACQUIRE REQUIRE ANY TYPE OF CONDITIONAL USE.

BUT THESE USES, SIMILAR TO THE PREVIOUS ORDINANCE, UM, REQUIRES A RE A ZONING OF M1 OR M TWO FOR THE COMMUNITY SCALE ENERGY FACILITY AND UTILITY SCALE SOLAR ENERGY FACILITY, ALONG WITH A APPROVED CONDITIONAL USE PERMIT.

UM, AND THAT'S WHAT WE HAVE BEFORE TONIGHT.

UM, YOUR ORDERS THAT YOU'VE SEEN BEFORE, YOU, UM, WE'LL SHOW YOUR, YOUR BEGINNING TEXT THAT, UH, THE SOLAR ORDINANCE HAS A, A LIMIT OF 7% OF LAND BY PARCEL, UM, TO BE USED FOR SOLAR.

UM, THE COMPREHENSIVE PLAN ALSO STATED THAT WE WOULD HAVE 10%, BUT NO MORE THAN 10%.

SO WHAT WE'RE DOING IS, UM, THE COMPREHENSIVE PLAN LEADS US TO, TO DEFINE AND WHAT WE DO WITH OUR ORDINANCES.

AGAIN, THE COMPREHENSIVE PLAN, UM, WAS SOMETHING THAT, THAT WE REQUIRED TO HAVE BY LAW.

THE ZONING ORDINANCE IS A TOOL TO, TO, UH, THAT WE'RE USING.

SO THE COMPREHENSIVE PLAN WAS APPROVED BY YOU ALL AS THE BOARD, UM, IN 2023.

AND THAT WHAT WE'RE DOING AT THIS TIME IS IMPLEMENTING THAT AND MAKING AMENDMENTS TO THE, TO THE SOLAR OR ENERGY ORDINANCE AND IMPLEMENT AN ACTUAL IMPLEMENTATION OF THE ATIVE PLAN.

SO BEFORE TONIGHT, WE DO HAVE, UM, SOME AMENDMENTS THAT HAVE BEEN PRESENTED TO THE PLANNING COMMISSION.

THE PLANNING COMMISSION HAS RECOMMENDED APPROVAL, UM, FOR, FOR THIS, UM, PROJECT.

I THINK THAT THE VOTE WHEN THAT WAS 10, 10 TO ZERO, UM, FOR THIS ORDINANCE AMENDMENT.

UM, WE HAVE GONE BACK AND FORTH AND WORKED THROUGH THIS IN DETAIL, UM, TO GET OVER, UM, MAKING SURE THAT EVERYONE WAS COMFORTABLE WITH, UH, WHAT WAS PRESENTED AND MAKING SURE THAT THAT VISION THAT THE PUBLIC BROUGHT TO US WHEN WE WORKED ON THE COMPREHENSIVE PLAN, THAT THOSE THINGS AND, AND ITEMS THAT WE FELT SHOULD BE ADDRESSED, WERE ADDRESSED IN, IN THE ORDINANCE.

UM, SO BEFORE YOU TONIGHT, UH, WE DO HAVE THE ORDINANCE IN YOUR PACKET IF YOU, UH, HERE FOR ANY QUESTIONS THAT YOU ALL MIGHT HAVE.

UM, IT WOULD BE RECOMMENDED THAT FOR THE SAKE OF CLARITY, UM, A GRANDFATHERING PROVISION BE INCLUDED IN THE ORDINANCE AMENDMENTS, OR NOT INCLUDED IN THE ORDINANCE AMENDMENTS, BUT AT LEAST HAVING THAT DISCUSSION WILL PROVIDE CLARITY FOR, UH, STAFF AND FOR APPLICANTS WHO, AGAIN, HAVE PROJECTS IN THE MIDST.

SO A LOT, ONE OF THE THINGS THAT HAPPENS, UM, WITH THE, THE GRAND FINAL LANGUAGE, UM, THERE ARE OTHER LOCALITIES WHO ACTUALLY HAVE SOME ITEMS. SOME OF THESE PIECES OF ITEMS ARE ARTICLES DEFINED WITHIN THEIR ZONING ORDINANCES.

SO WHEN THEY GO THROUGH AND, AND MAKE AN AMENDMENT TO THEIR ORDINANCE WHEN THEY HAVE SOME OF THESE PROJECTS IN PLACE, IT ALLOWS THE BOARD TO ACTUALLY MAKE CONSIDERATION FOR THOSE PROJECTS THAT MAY ALREADY BE WORKING THROUGH THE, THE APPLICATION PROCESS OR THE ACTUAL PERMITTED OR THE USES.

UM, UH, FOR EXAMPLE, WE DO HAVE ONE PROJECT THAT THEIR APPLICATION HAS BEEN, THEY'VE BEEN WORKING ON THE APPLICATION FOR A YEAR BEFORE WE EVEN STARTED WORKING ON THIS PARTICULAR ORDINANCE SECTION.

SO BEING ABLE TO ALLOW, UM, THAT GRANDFATHERING LANGUAGE AND THEY WOULD, WOULD PERMIT THAT PROJECT TO FOLLOW THE PREVIOUS ORDINANCE.

UH, THE PLANNING COMMISSION DID NOT, UH, CONSIDER GRANDFATHERING LANGUAGE BECAUSE THAT, THAT WOULD NOT BE APPROPRIATE FOR, FOR THEM TO CONSIDER.

THAT WOULD BE SOMETHING THAT THE GOV YOU ALL AS THE GOVERNING BODY, UM, WOULD AGAIN, BE ABLE TO RECOMMEND INCLUDING IT WOULD BE INCLUDED AS AN ENACTMENT CLAUSE.

UM, AND, AND AGAIN, THAT LANGUAGE IS IN, IS IN YOUR AGENDA MATERIALS.

AND, UM, THE ORDINANCE HELPS COMPANIES THAT ARE COMING TO US TO BETTER UNDERSTAND HOW TO BE GOOD PARTNERS WITH US.

FROM THE INFORMATION THAT'S IN THIS ORDINANCE, ALSO, IT BETTER REPRESENTS THE NEEDS OF OUR CITIZENS THAT ARE HERE.

SO I BELIEVE THE ORDINANCE HELPS BOTH SIDES.

AND SO THEREFORE, I ENCOURAGE YOU, UM, TO TAKE THE PLANNING, UH, COMMISSION'S RECOMMENDATION, UH, TO APPROVE THIS UPDATED ORDINANCE.

UM, YOU KNOW, OBVIOUSLY THAT CAN BE SOMETHING THAT'S HINDERING TO A SMALL LANDOWNER THAT I'D BE INTERESTED IN DOING A PROJECT AND COULD X THEM OUT FROM HAVING THAT POSSIBILITY.

I, UM, JUST WANT TO SPEAK A LITTLE BIT ABOUT THE CLEAN ENERGY DEVELOPMENT THAT I WOULD LIKE TO SEE NOT HINDERED HERE IN SURREY COUNTY.

UM, WE WOULD LIKE TO KNOW THAT THE BOARD WILL NOT HINDER CLEAN ENERGY DEVELOPMENT IN VIRGINIA BY DENYING CONDITIONAL USE PERMITS.

UM, BASED ON AN ARBITRARY CAP THAT WE'VE SEEN HERE.

THE CURRENT TOTAL NUMBER OF ACRES THAT ARE ALREADY DEVELOPED FOR SURREY COUNTY IS APPROXIMATELY 6%.

AND THE PROPOSED ENERGY ORDINANCE STATES THAT THE LAND USE CAP SHALL BE NO MORE THAN 7%.

SO WITH THAT BEING SAID, UM, THAT ALMOST MAKES THIS IMPOSSIBLE FOR FOLKS TO DEVELOP SURREY MOVING FOR, UM, TO DEVELOP SOLAR AND SURREY MOVING FORWARD.

SO THE PROPOSED ORDINANCE AMENDMENT NOTES THAT LAND CALCULATION FOR THE PROPOSED CAP IS BASED ON THE ENTIRE ACREAGE FOR PARCELS SEEKING A CONDITIONAL USE PERMIT.

THIS FURTHER CONTRIBUTES TO THE DIFFICULTY OF ESTABLISHING A PROJECT WITHIN THAT ACREAGE CAP.

SO IN ADDITION TO THE ARBITRARY CAP, IT'S ALSO IMPORTANT TO MENTION THAT THE COUNTY SETBACK LANGUAGE AND THE VEGETATIVE BUFFER ARE MUCH MORE RESTRICTIVE THAN IN OTHER PARTS OF THE STATE AND THE COUNTY SURREY'S PROPOSING A 300 FOOT SETBACK.

TYPICAL AND REASONABLE SETBACKS THAT WE SEE THROUGHOUT THE STATE AND THE COUNTRY ARE AROUND 150.

THIS, AGAIN, DENIES THE ABILITY FOR THE COUNTY TO BENEFIT FROM FUTURE RENEWABLE DEVELOPMENT AND WELL PLANNED AND THOUGHT OUT SOLAR PROJECTS.

ALSO, THIS IS PROPOSING A 300 FOOT WIDE VEGETATIVE BUFFER WITH FOUR ROWS OF STAGGERED EVERGREENS WITHOUT, UM, THE PROJECT PERIMETER.

AND WE WOULD SEE THAT THAT WOULD BE VERY COST PROHIBITIVE FOR ANY SOLAR COMPANY AND DEVELOPER TO COME IN AND DO SO.

IN LIEU OF THIS REQUIREMENT, WE WOULD SUGGEST THAT THE COUNTY CONSIDER ADOPTING LANGUAGE, ALLOWING DEVELOPERS TO SUBMIT A THIRD PARTY VIEW SHED MITIGATION PLAN, WHICH WE'RE SEEING HAPPEN THROUGHOUT THE STATE.

VIRGINIA NEEDS MORE SOLAR, WE NEED MORE WIND, WE NEED MORE BATTERY STORAGE TO SATISFY THE VIRGINIA CLEAN ECONOMY ACT.

SIMPLY PUT, WE NEED TO GENERATE MORE POWER TO KEEP UP WITH OUR DEMAND OR WE RISK CREATING THE SAME PROBLEMS WITH GRID RELIABILITY THAT OTHER STATES AROUND THE COUNTRY ARE FACING RIGHT NOW.

IN CONCLUSION, AS LEADERS OF SURREY COUNTY, YOU SEE THE INEVITABLE GROWTH OF INTER BASED, UM, INTERNET BASED SERVICES OF AI AND THE NEED TO COMPLY WITH THE CLEAN ECONOMY ACT.

ALL OF THESE FACTORS DEPEND ON THE SAME THING.

THE WILLINGNESS OF RURAL COUNTIES LIKE SURREY TO ACCEPT THIS AND APPROVE RENEWABLE SOLAR ENERGY PROJECTS.

I HOPE THAT THIS BODY WILL CHOOSE NOT TO LOWER THE SOLAR CAP AND USE THEIR AUTHORITY TO ACCEPT OR REJECT PROJECTS ON THEIR MERIT, NOT NECESSARILY THE CAP.

FIRST, THE PROJECT IS WELL CITED.

IT TAKES ADVANTAGE OF DENSE EXISTING VEGETATION THAT WILL FULLY SCREEN ARRAY AREAS FROM PUBLIC RIGHTS OF WAY WHILE AT THE SAME TIME MAKING USE OF EXISTING ZONING AND EXISTING INFRASTRUCTURE.

SECOND, A ES IS AN OWNER OPERATOR OF ITS FACILITIES.

THIS PROJECT WILL BE DESIGNED, BUILT, AND OPERATED BY ONE COMPANY BENEFITING FROM NATIONAL AND FROM LOCAL EXPERIENCE.

AND THIRD, SYCAMORE CROSS SOLAR WILL PROVIDE $4.1 MILLION IN REVENUE TO THE COUNTY.

THIS REVENUE CAN BE USED AS THE COUNTY SEES BEST TO BOLSTER SIRI'S QUALITY OF LIFE THROUGH IMPROVEMENTS TO SCHOOLS, EMERGENCY SERVICES, OR BY ADVANCING PROJECTS ALREADY IDENTIFIED IN THE COUNTY'S CAPITAL IMPROVEMENTS PLAN.

A ES IS A FORTUNE 500 COMPANY AND WE'RE HEADQUARTERED IN ARLINGTON, VIRGINIA.

OUR CLEAN ENERGY DIVISION HAS ITS PJM REGIONAL OFFICE IN RICHMOND.

THIS OFFICE SUPPORTS APPROXIMATELY 40 EMPLOYEES AND OVER 900 MEGAWATTS OF OPERATIONAL FACILITIES.

PERHAPS THE MOST IMPORTANT ASPECT OF A ES TO SURREY COUNTY IS THAT WE ARE THE OWNER OPERATOR OF THOSE FACILITIES.

AS I MENTIONED PREVIOUSLY, THAT MEANS THAT SURREY COUNTY ONLY DEALS WITH ONE COMPANY FROM DEVELOPMENT OF THE PROJECT THROUGH THE CONSTRUCTION OF THE PROJECT AND INTO THE OPERATIONS.

THIS OWNER OPERATOR ROLE HAS ALLOWED US TO LEARN FROM OUR EXPERIENCES IN DEVELOPING THE CAVALIER PROJECT IN YOUR COMMUNITY AND TO PUT THOSE LESSONS LEARNED INTO EFFECT ON THE SYCAMORE CROSS PROJECT.

LET'S PIVOT TO THE PROJECT DETAILS.

SYCAMORE CROSS IS A 240 MEGAWATT SOLAR FACILITY.

IT'S LOCATED IN SURREY AND ISLE OF WHITE WITHIN SURREY, THE PROJECT IS APPROXIMATELY 19 MEGAWATTS ON 125 FENCED ACRES.

THAT'S ONLY 10% OF THE ENTIRETY OF THIS PROJECT.

THE A A S TEAM HAS BEEN WORKING WITH THE COUNTY STAFF SINCE EARLY 2023 THROUGH OUR APPLICATION REVIEW, THROUGH MULTIPLE WORK SESSIONS WITH THE PLANNING COMMISSION, THROUGH MEETINGS WITH THE ZONING SUBCOMMITTEE, AND THROUGH A WORK SESSION WITH THIS VERY BOARD IN DECEMBER, SYCAMORE CROSS, I BELIEVE, WAS THE FIRST SOLAR PROJECT IN SURREY COUNTY TO RECEIVE A FAVORABLE RECOMMENDATION FOR APPROVAL FROM THE PLANNING COMMISSION.

IN ADDITION TO OUR EFFORTS WITH SURREY COUNTY, THIS PROJECT IS SEEN ANALYSIS BY NUMEROUS OTHER GROUPS.

TO DATE, WE'VE RECEIVED A STATE PERMIT KNOWN AS OUR CPCN FROM THE STATE CORPORATION COMMISSION.

WE'VE RECEIVED A CONDITIONAL USE PERMIT FOR MILE OF WHITE.

WE HAVE AN EXECUTED INTERCONNECTION AGREEMENT WITH PJM AND WE HAVE A POWER PURCHASE AGREEMENT IN PLACE.

NEXT, I'D LIKE TO REVIEW THE SUR PORTION OF THE PROJECTS IN DETAIL.

THIS FIRST FOCUS AREA SHOWS THE PROPOSED ARRAY ALONG THE MILL SWAMP ROAD TO THE FAR WESTERN END OF THE PROJECT.

IT REPRESENTS ROUGHLY 90 ACRES WITHIN THE FENCE AND 12 MEGAWATTS.

WE'VE HELD FOUR OPEN HOUSES WITH TWO OF THESE TAKING PLACE IN SURREY COUNTY.

ADDITIONALLY, WE'VE BEEN GATHERING FEEDBACK FROM OUR VARIOUS HEARINGS AND WORK SESSIONS, WHICH HAVE TAKEN PLACE OVER THE LAST YEAR.

SO WITH 900 MEGAWATTS IN VIRGINIA, WITH A S'S EXPERIENCES OVER 400 FACILITIES NATIONWIDE THROUGH THE CONSTRUCTION OF THE CAVALIER PROJECT AND THROUGH OUR SYCAMORE CROSS OUTREACH TEAM, WHAT ARE THE LESSONS THAT WE'VE LEARNED? FIRST AND FOREMOST, A ES MUST IMPROVE THE MANAGEMENT OF ITS CONSTRUCTION TRAFFIC.

SECOND, A ES MUST UNDERSTAND AND RESPECT THAT THE RURAL AESTHETIC AND THE LIFESTYLE ARE WHAT HAVE DRAWN MANY OF THE RESIDENTS TO THIS AREA.

THIRD, SURREY COUNTY IS MAKING A CONTINUOUS EFFORT TO EVOLVE, AND WE MUST ADOPT OUR PROJECTS TO MEET WITH THAT EVOLUTION.

AND FOURTH, THE BENEFITS FROM SOLAR PROJECTS MUST BE IMPACTFUL TO THE COMMUNITY IN WHICH THEY ARE LOCATED.

SO A ES HAS TAKEN THE FEEDBACK, WE'VE PROCESSED THE CONVERSATIONS, AND NOW WE MUST GENERATE ACTIONABLE ITEMS TO IMPLEMENT THESE LESSONS.

I'D LIKE TO TAKE THESE NEXT FEW SLIDES TO TALK THROUGH HOW WE PLAN TO IMPLEMENT THESE LESSONS LEARNED INTO THOSE ACTIONABLE ITEMS. FOR THE SYCAMORE CROSS PROJECT, IT'S IMPORTANT TO UNDERSTAND THAT SYCAMORE CROSS IS THE INVERSE OF THE CAVALIER PROJECT.

INSTEAD OF TRAFFIC COMING FROM ROUTE 10 AND SOUTH DOWN WHITE MARSH ROAD, AS IT DID WITH CAVALIER TRAFFIC WILL COME UP FOUR 60 USING PROCTOR'S BRIDGE ROAD AND IN OF WHITE.

INSTEAD OF THE MAJORITY OF THIS PROJECT BEING BUILT IN SURREY COUNTY, 90% OF THIS PROJECT WILL BE BUILT IN ISLE OF WHITE.

NONE OF THIS MATTERS IF OUR CONTRACTORS ARE NOT RESPONSIBLE AND WE ARE NOT ACCOUNTABLE.

SO WE ENACT FOUR MAIN STRATEGIES TO CREATE AN ENHANCED TRAFFIC MANAGEMENT PLAN, ENSURING THE RESPONSIBILITY AND ACCOUNTABILITY WE WILL COMPLETE CON PRE-CONSTRUCTION ROAD IMPROVEMENTS SUCH AS REINFORCING SHOULDERS AND INTERSECTIONS TO MAKE CERTAIN ROAD CONDITIONS DO NOT BECOME A CHALLENGE TO LOCAL COMMUTES.

WE WILL USE THIRD PARTY ENFORCEMENT AS A PLAN ALONG WITH THE COMMUNITY LIAISON TO ENSURE THAT NEIGHBORS HAVE CLEAR PATHS FOR COMMUNICATING WITH THE PROJECT TEAM.

WE WILL ENACT CONSTRUCTION TRAFFIC RESTRICTIONS ALONG THE SWAMP ROAD, AND WE WILL ENSURE ACCOUNTABILITY THROUGH A PROPOSED CONDITION, WHICH INCLUDES FINANCIAL PENALTIES FOR VIOLATIONS OF THE TRAFFIC MANAGEMENT PLAN TO IMPLEMENT THE ROYAL AESTHETIC AND LIFESTYLE.

WITH THE SYCAMORE CROSS PROJECT, A ES WILL KEEP THE EXISTING AESTHETIC BY LEAVING THE VEGETATION IN PLACE, AS I'VE ALREADY SHOWN YOU TO PROVIDE NATURAL SCREENING.

SECONDLY, A ES WILL MAKE A COMMITMENT TO AGRICULTURE BY USING ROTATIONAL SHEEP GRAZING AND HARVESTING GROUND COVER WITHIN THE ARRAYS, WHICH CAN BE USED FOR SHEEP OR FOR LOCAL LIVESTOCK.

TO IMPLEMENT OUR THIRD LESSON LEARNED, SYCAMORE CROSS IS EVOLVING WITH THE COUNTY'S REQUIREMENTS FOR ENERGY FACILITIES.

WE BEGAN DEVELOPING THIS PROJECT IN THE SUMMER OF 22 BEFORE WE EVEN BROUGHT THIS BEFORE MR. WADE IN 2023.

WITH THE CURRENT ORDINANCE IN PLACE, OR THE PRIOR OR CURRENT ORDINANCE, APOLOGIES SHIFT ON THE FLY.

SINCE THAT TIME, SURRY HAS AMENDED ITS COMPREHENSIVE PLAN AND IS IN THE PROCESS, OR HAS THIS EVENING AMENDED ITS ORDINANCE TO MATCH.

EFFECTIVELY.

REVISIONS TO THE ORDINANCE FALL INTO TWO CATEGORIES, THOSE REQUIREMENTS THAT ARE SIMPLY APPLICATION MATERIALS AND THOSE REQUIREMENTS THAT ARE PERFORMANCE BASED RELATED TO CONSTRUCTION AND OPERATIONS.

A ES HAS RECENTLY SUBMITTED SUPPLEMENTAL APPLICATION MATERIAL TO MR. WADE, SUCH AS OUR EVIDENCE OF INTERCONNECTION REQUEST, ADDITIONAL DESCRIPTION OF SITE ACCESS POINTS AND PROJECT ROADS, AND THE INCLUSION OF A US DEPARTMENT OF AG SOIL SURVEY TO ADDRESS REVISIONS TO ITEMS SUCH AS PERFORM THAT ARE PERFORMANCE BASED.

A S HAS BEEN REVISING ITS PROPOSED CONDITIONS SINCE THE ADOPTION OF THE ENERGY AMENDMENT TO THE COUNTY'S COMPREHENSIVE PLAN.

WE MOST RECENTLY ADDED TWO NEW CONDITIONS IN RESPONSE TO DISCUSSIONS IN JANUARY'S WORK SESSION WITH THE BOARD.

ADDITIONALLY, I WOULD REMIND YOU THAT ALL OF THE EFFORT TO WORK WITH STAFF AND TO MAKE CONTINUOUS IMPROVEMENTS TO OUR PROJECT HAS LED TO A FAVORABLE RECOMMENDATION FROM THE STAFF.

HERE ARE JUST A FEW WAYS WE'RE IMPROVING TO MEET THE NEW ORDINANCE.

HOURS OF CONSTRUCTION HAVE BEEN REDUCED EVEN FURTHER IN OUR PROPOSED CONDITION THAN WHAT IS IN THE REVISION TO THE ORDINANCE, AND SHALL INCLUDE NO WORK ON SUNDAYS.

THE REQUIREMENT FOR OPAQUE BUFFER SHALL BE ACHIEVED USING THE EXISTING VEGETATION.

AND WHEN DETERMINED THAT THAT EXISTING VEGETATION MAY MAY NOT BE SUFFICIENT DUE TO GROWTH, WE WILL ENHANCE THE BUFFER INVERTERS SHALL BE SET BACK 500 FEET FROM NON-PARTICIPATING PROPERTY LINES AND 750 FEET FROM ANY EXISTING RESIDENTIAL STRUCTURE.

BUT ADDITIONALLY, WE SUGGEST A MEASURABLE SOUND LEVEL ADJACENT PROPERTY LINES SO THAT THERE IS A BENCHMARK TO CHECK TO ADDRESS REQUIREMENTS FOR STORM WATER.

WE WILL USE SEATING PRIOR TO INSTALLATION OF MECHANICAL AND ELECTRICAL, AND WE WILL PAY FOR A THIRD PARTY INSPECTOR TO MONITOR EROSION AND SETTLEMENT CONTROL COMPLIANCE.

AND LASTLY, WE'VE AGREED TO MEET THE SHORT AND SIX MONTH DECOMMISSIONING WINDOW.

WE'LL INCLUDE A MINIMUM SURETY OF $500,000, WHICH CAN BE AND WILL BE REVISED AS NEEDED, DETERMINED BY A THIRD PARTY ENGINEER'S REVIEW EVERY FIVE YEARS.

IN IMPLEMENTATION OF OUR FINAL LESSON LEARNED, WE ADDRESS THE COMMUNITY BENEFIT AND HOW IT CAN BE IMPACTFUL.

I BELIEVE THERE ARE TWO ASPECTS TO COMMUNITY BENEFIT.

FIRST, THE INTANGIBLE BENEFIT PROVIDED BY A MEMBER OF THE BUSINESS COMMUNITY WHO IS ACTIVELY ENGAGED.

WE VOLUNTEER WITH VIRGINIA PENCIL FOOD BANK AT ITS SURREY MOBILE FOOD DISTRIBUTION CENTER.

WE VOLUNTEER WITH, PARDON ME.

UM, WE'VE SPONSORED THE FOUR H PROGRAM TO SUPPLY TRANSPORTATION FOR SUMMER PROGRAMMING.

AND MOST RECENTLY WE SPONSORED THE JAMES RIVER ASSOCIATION, WHICH HAS USED THE FUNDING TO SUPPORT THE LOWER JAMES EDUCATIONAL INITIATIVES WORKING WITH 46 SEVENTH GRADERS FROM THE MIDDLE SCHOOL.

A ES IS PROPOSING, SORRY, GOT AHEAD OF MYSELF WITH A ES HELPING TO ADDRESS COMMUNITY NEEDS THROUGH PHILANTHROPY AND VOLUNTEER EFFORTS.

THE SYCAMORE CROSS PROJECT WILL DIRECTLY BENEFIT THE COUNTY AS SOURCES OF REVENUE.

THE SYCAMORE CROSS PROJECT HAS PROPOSED A CITING AGREEMENT THAT INCLUDES UPFRONT PAYMENTS, TOTALING $1.6 MILLION.

WE'VE PROPOSED VOLUNTARY ANNUAL PAYMENTS BASED ON A PER MEGAWATT AMOUNT, WHICH TOTALS $1.2 MILLION.

THESE VOLUNTARY PAYMENTS, ALONG WITH THE REQUIRED M AND T TAX AND THE INCREASED REAL ESTATE TAX, WILL TOTAL $4.1 MILLION.

THROUGH OUR ENGAGEMENT, WE UNDERSTAND THAT CERTAIN MEMBERS OF THE COMMUNITY MAY FEEL MORE DIRECTLY IMPACTED BY THE CONSTRUCTION AND OPERATION OF A PROJECT.

TO ADDRESS THIS, WE PROPOSE A COMMUNITY BENEFITS FUND TO BE ADMINISTERED BY THE COUNTY AND HAVE SUGGESTED AN AMOUNT OF $250,000.

A ES IS PROPOSING SEVERAL ALTERNATIVES TO THE SITING AGREEMENT, AND WE ARE OPEN TO DISCUSSIONS.

TO BEGIN, WE WILL VOLUNTARILY INCREASE THE EMERGENCY SERVICES SUPPORT PAYMENT TO $150,000.

WE CONSISTENTLY HEARD DURING DISCUSSIONS WITH THE PLANNING COMMISSION AND THE BOARD THAT THE COUNTY IS IN NEED OF A BRUSH TRUCK, RECOGNIZING THE ABILITY THIS WOULD HAVE TO SERVICE VARIOUS SOLAR FACILITIES WITHIN SURREY.

WE SEE THIS AS A WIN-WIN FOR BOTH.

WE HAVE ALSO SHOWN IN THIS ALTERNATIVE THE REALLOCATION OF THE FUNDS IN THE ADDITIONAL PAYMENTS, WHICH COULD, IF DESIRED SUPPORT AN INCREASE IN COMMUNITY BENEFITS FUND OR OTHER FUNDS.

AND TO THE RIGHT SIDE, WE HAVE SHOWN THREE OPTIONS WHICH HELP TO GUARANTEE THE ANNUAL PAYMENTS OVER A SHORTENED PERIOD OF 10, 15, OR 20 YEARS.

SALES SHOWN IN BLUE ARE A COMBINATION OF VOLUNTARY PAYMENTS AND THOSE IN BEIGE, PARDON ME, AND THOSE IN BEIGE REPRESENT ONLY THE M AND T TAX PAID AFTER THE GUARANTEE PERIOD HAS EXPIRED.

THE BOTTOM TWO ROWS OF THESE SALES SHOW THE TOTAL PAYMENTS OVER A 35 YEAR LIFE AND THE SUBSEQUENT NET PRESENT VALUE.

FOR EASE OF COMPARISON, AT THE BEGINNING OF THIS PRESENTATION, I MENTIONED THREE PILLARS ON WHICH SYCAMORE CROSS CAN BE SUPPORTED.

NUMBER ONE, THIS PROJECT IS WELL CITED WITH LIMITED IMPACTS TO VIEW SHED AND CAN TAKE ADVANTAGE OF EXISTING INFRASTRUCTURE AND ZONING.

NUMBER TWO, A ES IS THE OWNER OPERATOR WHO IS ENGAGED WITH AND LISTENING TO THE CONCERNS OF RESIDENTS AND STAFF.

BUT ONE OF THE THINGS THAT THEY CAN ADDRESS IS THAT, UH, SOLAR FARMS LEACH HEAVY METALS AND THAT WILL CONTAMINATE THE DIRT.

SO WHEN THEY, UM, YOU KNOW, I UNDERSTAND THAT NOT JUST WHEN THEY BREAK, BUT ALSO JUST IN GENERAL, THEY LEAKED, CAN, UH, CONTAIN HEAVY METALS WITH THE PIN TO THE EARTH.

I DON'T KNOW WHAT THAT DOES TO THE GROUNDWATER.

UM, BUT SOLAR FARMS HAVEN'T REALLY BEEN IN THE UNITED STATES FOR VERY LONG.

AND AS FAR AS I KNOW, I DON'T KNOW IF THERE ARE ANY STUDIES THAT SHOW THE EFFECTS ON GROUNDWATER, UM, UH, FROM INSTALLING SOLAR FARMS LIKE THIS.

ANOTHER THING IS SOLAR ENERGY IS ONLY VIABLE BECAUSE OF FEDERAL SUBSIDIES.

THEY DIDN'T SHOW UP TILL ABOUT, UH, I THINK IT WAS IN 2018, TWO CONGRESS PASSED AN ACT THAT SUBSIDIZED SOLAR FARMS. AND THAT'S THE ONLY REASON THAT THEY'RE HERE.

THAT'S THE ONLY RIGHT REASON THEY EXIST.

THEY DON'T MAKE MONEY IN AND OF THEMSELVES.

SO I WOULD LIKE TO, UH, UH, URGE THE BOARD TO DENY THIS.

SO THERE IS A SPECIFIC AMOUNT OF MONEY EARMARKED FROM NOW UNTIL 2022 THROUGH 2039, SPECIFICALLY FOR SURREY COUNTY.

UH, THE VIRGINIA LEGISLATURE CREATED, UH, THE OPIOID ABATEMENT AUTHORITY, WHICH IS THE AGENT STATE AGENCY THAT MANAGES THESE FUNDS.

SO WE HAVE, THERE ARE TH THREE DIFFERENT POTS OF MONEY, ESSENTIALLY IN WITHIN THE OPIOID ABATEMENT.

AUTHORITIES CONTROL.

THERE ARE WHAT'S CALLED DIRECT FUNDS INDIVIDUAL DISTRIBUTIONS AND GOLD STANDARD DISTRIBUTIONS.

THERE'S ALSO ANOTHER, A FOURTH BOT, WHICH IS THE COOPERATIVE PARTNERSHIP GRANT FUND.

AND SO WHAT WE'VE BEEN WORKING ON IS WE HAVE A PARTNERSHIP WITH, WELL, I'M ASKING YOU TO AGREE TO A PARTNERSHIP, BUT, UH, WE'VE BEEN WORKING WITH HOPEWELL PRINCE, GEORGE DENWITTY AND SUSSEX COUNTY, UH, ALONG WITH THE DISTRICT 19 COMMUNITY SERVICES BOARD FOR, UH, COOPERATIVE PARTNERSHIP APPLICATION.

AND SO WHAT WE'RE ASKING YOU TO DO TONIGHT IS ESSENTIALLY SIGN THIS APPLICATION AND APPROVE THAT.

AND THAT WOULD ALLOW US TO ENTER INTO, UM, AN AGREEMENT WITH THOSE OTHER LOCALITIES AND SUBMIT A GRANT APPLICATION TO THE OPIOID ABATEMENT AUTHORITY BY THE APRIL 1ST DEADLINE.

AND I TALKED TO YOU A LITTLE BIT BEFORE ABOUT WHAT THE PROJECT IS, AND ESSENTIALLY IT'S GONNA BE A MOBILE OVERDOSE RESPONSE UNIT.

AND THIS WOULD, UH, BE, IT WOULD BE MANAGED THROUGH DISTRICT 19 COMMUNITY SERVICES BOARD, WOULD BE ESSENTIALLY A STAFF OF A CERTIFIED PEER RECOVERY RECOVERY SPECIALIST, AND THEN POSSIBLY A LAW ENFORCEMENT AND EMS ATTACHMENT TO THAT.

UH, ALL THAT FUNDING WOULD COME OUT OF THE GRANT FUNDING.

SO WHAT WOULD, THIS WOULD REQUIRE? ZERO GENERAL FUND DOLLARS FROM THE COUNTY.

UH, SO IF, IF THE GRANT IS APPROVED AND THE COOPERATIVE PARTNERSHIP, UH, FUNDING IS APPROVED, THEN WE WOULD CONTINUE TO WORK WITH THE OTHER LOCALITIES ON, UH, PUTTING TOGETHER A DETAILED OPERATING PROCEDURES FOR THIS PROGRAM.

AND THEY DO REQUEST SOME MATCH FROM YOU, UH, TO MAKE YOUR APPLICATION MORE COMPETITIVE.

BUT THROUGH OUR CONVERSATIONS WITH THE OPIOID ABATEMENT AUTHORITY, WE ARE ABLE TO USE OUR INDIVIDUAL AND GOLD STANDARD FUNDS THAT WE'RE RECEIVING FROM THEM AS THE MATCH.

SO THESE ARE FUNDS THAT ARE COMING FROM THEM, UH, THAT HAVE RESTRICTIONS ON TIME LIMITS WHEN THEY CAN BE SPENT, RESTRICTIONS ON HOW THEY CAN BE USED SPECIFICALLY FOR THE PURPOSE OF OPIOID ABATEMENT.

AND WE ARE ABLE TO USE THE FUNDS THEY'RE GIVING US TO THEN TURN AROUND AND APPLY FOR MORE FUNDS FROM THEM.

SO THAT'S OUR MATCH.

SO IT'S NOT GONNA, UH, CALL FOR ANY GENERAL FUND DOLLARS.

UH, IF YOU'LL NOTICE TO THE, IN THE AGREEMENT YOU HAVE BEFORE YOU, YOU'LL SEE THAT, UH, PRINCE GEORGE AND SURREY IN THE, THE CHART IN THAT AGREEMENT ALSO SHOWS THE DIRECT DIRECT DISTRIBUTION THROUGH OUR SORT OF NEGOTIATIONS OF WHAT WE THOUGHT WOULD BE PALATABLE FOR OUR RESPECTIVE BOARDS.

UM, AND I OFTEN GET ASKED THE QUESTION OF KIND OF THE NEED FOR, FOR THIS IN, SIR, IS, IS THE SUBSTANCE USE PROBLEM, UH, THAT BAD? I, I WOULD SAY IT IS.

UH, IF YOU LOOK AT THE STATISTICS, OUR REGION, WHICH INCLUDES THE DISTRICT 19 AREA, IS ONE

OF THE HIGHER AVERAGES IN THE STATES FOR OVERDOSE.

UM, THERE IS A PROBLEM WITH COLLECTING DATA AND THAT'S ONE OF THE OTHER THINGS THAT THIS, UM, MOBILE RESPONSE UNIT WOULD DO, WOULD BE COLLECTING DATA.

AND SO SOME OF THE PROBLEMS WITH THE DATA COLLECTION ARE, THEY'RE INPUT DIFFERENTLY THROUGH DIFFERENT AGENCIES.

SO SOME OF THESE OVERDOSES GO STRAIGHT TO HOSPITAL, SOME OF THEM ARE REPORTED THROUGH EMS, SOME THROUGH LAW ENFORCEMENT, UM, AND SOME NOT REPORTED AT ALL.

AND ANECDOTALLY, JUST THINKING OF STACK OF CASES ON MY DESK BEFORE I LEFT THE OFFICE TODAY, UH, THREE, I WAS WORKING ON THIS AFTERNOON WHERE A FENTANYL OVERDOSE RESULTING IN A, IN A CRASH WITH A CHILD IN A VEHICLE, UH, A OPIOID OVERDOSE ON THE FERRY WITH POSSESSION AND A SUBSTANCE ABUSE, FUEL ABDUCTION AND SEXUAL ASSAULT WERE JUST THREE CASES THAT WERE ON MY DESK I WAS LOOKING AT BEFORE WALKING OVER HERE.

SO, UH, ANECDOTALLY I CAN, I CAN TELL YOU IT'S ALSO A PROBLEM.

SO THAT IS WHAT I'M ASKING FOR YOU TO DO TODAY, IS JUST TO PROVE THIS COOPERATIVE PARTNERSHIP SO THAT WE CAN APPLY TO THE OPIOID ABATEMENT AUTHORITY FOR THIS GRANT WITH THE OTHER LOCALITIES.

AND ALSO, UH, IT'S NOT GONNA REQUIRE ANY, ESSENTIALLY, LABOR COSTS FROM US EITHER BECAUSE PRINCE GEORGE COUNTY IS GONNA BE ACTING AS THE FISCAL AGENT TO MANAGE THE FUNDS AND BE HAPPY TO TAKE ANY QUESTIONS.

SO THERE IS AN AGREEMENT THAT WHEN WE COME UP WITH THE OPERATING PROCEDURES, THAT THAT IS GONNA BE TOP OF MIND TO MAKE SURE THAT A LOCALITIES THAT HAVE, UM, YOU KNOW, 'CAUSE CERTAINLY THE LARGER LOCALITIES ARE GONNA HAVE MORE NEED.

BUT SO WE'VE AGREED ON, UH, COMING UP WITH AN EQUITABLE SHARING OF THE RESOURCES.

ADDITIONALLY, THE RESOURCES ARE NOT GONNA BE HOUSED BY ANY ONE JURISDICTION.

SO ESSENTIALLY WHAT IT'S GONNA BE IS, UH, SOME STAFF IN A VEHICLE AND, AND SOME EQUIPMENT.

AND THAT'S GONNA BE MANAGED IN UNDER THE DIRECTION OF DISTRICT 19 COMMUNITY SERVICES BOARD, WHICH PROVIDES SERVICES TO EVERYONE IN THE LOCALITY.

BUT, UH, YES, THAT, THAT WAS THE BIG CONCERN IS WELL, IT'S SMALLER JURISDICTION BECAUSE WE'RE PUTTING IN LESS MONEY, RECEIVE LESS SERVICES AND, AND NO, IT'S, UH, ESSENTIALLY ONE OF THE OPTIONS WE TALKED ABOUT WAS WHEN THE REPORTS COME IN, COMES IN ON A FIRST COME FIRST SERVE BASIS.

SO EVEN THOUGH HOPEWELL MIGHT HAVE 50 MORE PEOPLE WAITING, IF OURS COMES IN LINE, THAT'S THE ORDER IT GOES IN.

SO WE'RE BRINGING ALL THOSE PEOPLE TOGETHER AND WE'VE TALKED ABOUT, UH, CODING THROUGH THEIR DISPATCHES, THROUGH RESPECTIVE

THERE'S A SPECIFIC CODING IN THEIR DISPATCH REPORTS, UH, THAT WILL MARK IT AS EITHER OPIOID OVERDOSE OR SUBSTANCE USE RELATED.

UH, WE, WE GET SOME OF THAT INFORMATION NOW BECAUSE A LOT OF DISPATCH WILL SHOW IF NARCAN WAS DISTRIBUTED, BUT IT'S BEING DONE DIFFERENTLY ACROSS DIFFERENT AGENCIES AND ACROSS DIFFERENT COUNTIES.

SO THAT'S WHAT WE'RE GONNA TRY TO DO, UM, WITH THIS SYSTEM AS WELL, IS MAKE IT MORE UNIFORM.

UM, YOU MENTIONED ABOUT THE, I GUESS, LAW ENFORCEMENT EMS, UM, HOW IS THAT REALLY IMPACTING OUR COUNTY? IS IT LIKE, SO IT'S, THIS IS NOT GONNA BE LAW ENFORCEMENT OR EMS THAT WE WOULD HAVE TO PROVIDE THE FUNDING IN THE COOPERATIVE GRANT APPLICATION PAYS FOR THAT.

SO IT WOULD BE A, A FULL-TIME EMS PERSON, A PEER RECOVERY SPECIALIST.

THAT'S WHAT THESE FUNDS ARE PAYING FOR.

SO IT'S NOT LIKE WE'RE GONNA SAY, UH, WHEN THEY GO OUT IN OUR JURISDICTION, YOU'VE GOTTA HAVE SOMEBODY FROM OUR EMS GO WITH THEM.

THEY'RE GONNA HAVE SOMEBODY ON STAFF ALREADY THAT GOES WITH THEM.

UH, FOR THE LAW ENFORCEMENT PIECE, THERE'S GONNA BE FUNDING IN THERE, ESSENTIALLY TO, TO PAY AN OFF-DUTY OFFICER.

UH, AND I THINK THE, DON'T QUOTE ME ON THIS, I, I DON'T WANT TO TELL YOU THE RATE BECAUSE IT'S THE SAME RATE DISTRICT 19 CURRENTLY USES WHEN THEY REQUEST, UH, OFF-DUTY LAW ENFORCEMENT OFFICERS TO GO WITH THEM FOR, FOR ASSISTANCE.

AND IT IS A VERY HIGH RATE.

SO THEY HAVE NO PROBLEM GETTING OFF-DUTY OFFICERS WANTING TO VOLUNTEER TO GO DO THIS WORK BECAUSE THEY'RE GETTING PAID SIGNIFICANTLY MORE THAN THEIR CURRENT RATES.

AND IT'S, UM, SO IT'S A PRETTY HIGH HOURLY RATE.
